1. Acceptance of Terms

By accessing or using the WithYou.gg web application, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Web Application or any associated services.

2. Eligibility

• You must be at least 18 years of age to use WithYou independently.
• Users between 13–17 years may use the Web Application only with verified parental or guardian consent.
• By using the Web Application, you confirm that you meet the eligibility requirements and have the legal capacity to enter into this agreement.

3. Nature of the Service

WithYou is an AI-powered self-awareness and emotional insight platform designed to help individuals understand their inner patterns, behaviors, and life direction. It provides:

• AI-driven personality, emotional, and behavioral analysis based on inputs such as handwriting, signatures, and numerology.
• Personalized insights to help users reflect, gain clarity, and improve decision-making.
• A private, judgment-free AI chat space for emotional expression and guided self-reflection.
• Tools and reports focused on pattern recognition, mindset awareness, and personal growth.
• Educational and interpretative content designed to support self-understanding, relationships, and life direction.

4. Crisis & Emergency Situations

WithYou is an AI-based self-awareness and support platform and not an emergency or crisis intervention service. It is not designed to handle situations involving immediate risk, harm, or severe mental distress. If you or someone you know is in immediate danger or experiencing a health emergency, please seek urgent professional help. WithYou does not provide crisis management, medical advice, or emergency response services. Users are solely responsible for seeking appropriate professional assistance in urgent situations. WithYou shall not be held liable for any outcomes resulting from the failure to obtain timely emergency or professional care.

5. User Accounts

• You must create an account to access certain features.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate, current, and complete registration information.
• You must notify us immediately of any unauthorized use of your account.
• One person may not maintain multiple active accounts.
• We reserve the right to suspend or terminate accounts that violate these Terms.

6. Acceptable Use

You agree to use WithYou only for lawful, personal, non-commercial purposes. You must NOT:

• Use the Web Application to harm, threaten, harass, bully, or intimidate other users.
• Share content that promotes self-harm, suicide, violence, or hate speech.
• Impersonate any person, entity, or mental health professional.
• Upload or transmit malware, viruses, or any harmful code.
• Attempt to reverse-engineer, scrape, or exploit the Web Application or its systems.
• Use the Web Application to solicit personal information from minors.
• Engage in any activity that disrupts or interferes with the Service.
• Use the platform for commercial solicitation without written permission.

Violation of these rules may result in immediate account suspension or termination.

7. Content & Community Guidelines

Where community or social features exist:

• You are solely responsible for content you post, share, or submit.
• Do not share graphic, triggering, or distressing content without appropriate content warnings.
• Respect the vulnerability of fellow users; this is a safe, supportive space.
• WithYou reserves the right to remove any content deemed harmful, inappropriate, or in violation of these Terms without prior notice.

8. Privacy & Data

Your privacy is central to our mission. Our Privacy Policy governs how we collect, use, store, and protect your personal and health-related data. Key points:

• We collect wellness data (mood logs, journal entries, usage patterns) to personalize your experience.
• We do not sell your personal or health data to third parties.
• Mental health-related data is handled with the highest level of confidentiality and security.
• You may request deletion of your data at any time by contacting us at withyou@primenest.co.in.

By using the Web Application, you consent to the data practices described in our Privacy Policy.

9. Subscriptions & Payments

• WithYou may offer free and premium subscription plans.
• Subscription fees are billed in advance on a monthly or annual basis.
• All payments are processed securely through third-party payment gateways.
• Refunds: Subscriptions are generally non-refundable except where required by applicable law. Refund requests may be submitted within 7 days of a charge to withyou@primenest.co.in.
• We reserve the right to modify pricing with at least 30 days' prior notice.
• Failure to pay may result in downgrade to a free plan or suspension of access.

10. Intellectual Property

• All content on WithYou — including but not limited to text, graphics, audio, videos, AI models, and software — is the exclusive property of WithYou or its licensors.
• You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Web Application for personal purposes.
• You may not copy, reproduce, distribute, modify, or create derivative works from any WithYou content without prior written consent.
• By submitting content to WithYou (e.g., journal entries shared publicly), you grant us a non-exclusive, royalty-free license to use that content solely to operate and improve the Service.

11. Third-Party Services

WithYou may integrate or link to third-party services (e.g., payment processors, analytics tools, licensed content providers). We are not responsible for the content, privacy practices, or availability of third-party services. Your use of such services is governed by their respective terms and policies.

12. Disclaimers

To the fullest extent permitted by applicable law:

• The Web Application is provided "as is" and "as available" without warranties of any kind.
• WithYou does not warrant that the Web Application will be uninterrupted, error-free, or free of harmful components.
• WithYou expressly disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
• WithYou is not responsible for any decisions made based on content or features of the Web Application.

13. Limitation of Liability

To the maximum extent permitted by law, WithYou and its officers, directors, employees, and partners shall not be liable for any:

• Indirect, incidental, special, or consequential damages.
• Loss of data, revenue, profits, or goodwill.
• Damages arising from reliance on Web Application content as medical or clinical advice.
• Harm resulting from unauthorized access to your account.

Our total aggregate liability to you for any claim arising out of your use of the Web Application shall not exceed the amount you paid to WithYou in the 3 months preceding the event giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless WithYou and its affiliates from any claims, damages, liabilities, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the Web Application.
• Your violation of these Terms.
• Your violation of any applicable laws or regulations.
• Content you submit or share through the Web Application.

15. Termination

• You may delete your account at any time through the Web Application settings.
• WithYou reserves the right to suspend or terminate your access at any time, with or without notice, for violation of these Terms or for any conduct we deem harmful to users or the platform.
• Upon termination, your right to use the Web Application ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

16. Governing Law & Dispute Resolution

• These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
• Any disputes arising from these Terms or your use of the Web Application shall first be attempted to be resolved through good-faith negotiation.
• If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, with proceedings held in Mohali, Punjab, India.
• Nothing in this clause prevents either party from seeking injunctive relief in a court of competent jurisdiction.

17. Changes to These Terms

We may update these Terms from time to time. When we do:

• We will post the updated Terms in the Web Application with a revised "Last Updated" date.
• For significant changes, we will notify you via email or in-platform notification at least 14 days in advance.
• Continued use of the Web Application after the effective date constitutes acceptance of the revised Terms.
